Phase I Environmental Site Assessment (ESA): The Foundation of Due Diligence

A Phase I ESA is the primary tool used to identify Recognized Environmental Conditions (RECs)—the presence or likely presence of hazardous substances or petroleum products on a property. Performed in accordance with ASTM E1527-21 standards, this non-intrusive investigation involves:

Site Visit: A thorough physical inspection of the property to catalog the presence of hazardous materials, petroleum products, and storage tanks.
Historical Research: A deep dive into past land use using aerial photographs, Sanborn Fire Insurance Maps, reverse street directories, building permits, and topographical maps
Regulatory Research: Reviewing federal, state, and local environmental agency records to identify known contamination cases or enforcement actions.

Phase II ESA: Subsurface Investigation and Testing

If a Phase I ESA identifies RECs, a Phase II Environmental Site Assessment is initiated to determine if contamination is actually present. Following ASTM E1903 standards, this phase involves intrusive testing to confirm or rule out environmental impacts:

Media Sampling: Collection and laboratory analysis of soil, groundwater, surface water, and soil vapor samples.
Geophysical Surveys: Use of specialized equipment to locate buried objects, such as Underground Storage Tanks (USTs) or drums, that could be sources of contamination.
Risk Assessment: detected contaminant concentrations are compared against regulatory standards set by agencies like the TCEQ to evaluate risks to human health and the environment.

Phase III ESA and Remediation: Solving the Problem

When a Phase II investigation reveals significant contamination, a Phase III ESA—often referred to as remediation—is conducted to determine the magnitude of the release and implement a cleanup plan. This phase focuses on:

Characterization: Additional testing, including the installation of groundwater monitoring wells and soil vapor probes, to define the full extent of the “plume”.
Remedial Action Plans: Designing systems tailored to the site’s unique geology, which may include bioremediation, soil vapor extraction, or groundwater pump and treat systems
Brownfields and VCP: For urban properties, we utilize risk-based closure strategies and state programs like the Voluntary Cleanup Program (VCP) to expedite site closure and return environmentally impaired land to productive use.
